包機(jī)運(yùn)輸怎么付費(fèi)?取消包機(jī)要付哪些費(fèi)用?
商業(yè)保級(jí)運(yùn)輸要付哪些費(fèi)用?怎么付款?如果因?yàn)槟承┰蛉∠鼨C(jī)會(huì)產(chǎn)生什么費(fèi)用?璟文物流為您梳理一下關(guān)于包機(jī)運(yùn)輸費(fèi)用方面的問(wèn)題。
包機(jī)運(yùn)輸付款政策及相關(guān)規(guī)定: Payment
(一) 如包機(jī)合同簽訂日期距飛行首日15天(含)以上的,則包機(jī)人必須于簽訂合同后三個(gè)工作日內(nèi)支付全部包機(jī)款的30%作為預(yù)付款,余額需在首日飛行前3天(含)支付完畢;
(1)If the charter contract is signed more than fifteen days (including the fifteenth day) in advance of the date of first flight, the charter shall pay 30% of the total freight as down payment within three business days after signing the contract, and pay the remaining freight within three days before the date of first flight or on the date of first flight.
(二) 如包機(jī)合同簽訂日期距飛行首日15天(不含)以內(nèi)的,則包機(jī)人需在首日飛行前3天(含)支付完畢包機(jī)款全款;
(2)If the charter contract is signed less than fifteen days (excluding the fifteenth day) in advance of the date of first flight, the charter shall pay full freight within three days before the date of first flight or on the date of first flight.
(三) 如包機(jī)合同簽訂日期距飛行首日3天內(nèi)(含),則包機(jī)人需在首日飛行前1個(gè)工作日16:00前支付包機(jī)款全款并提供付款憑證;
(3)If the charter contract is signed within three days (including the third day) before the date of first flight, the charter shall pay full freight before 16:00 of the business day before the date of first flight, and provide payment voucher.
(四) 如包機(jī)人取消飛行時(shí)尚未支付包機(jī)款,則包機(jī)人必須在簽訂取消合同后3個(gè)工作日內(nèi)(含)支付取消費(fèi)給承運(yùn)人,逾期需按照合同規(guī)定支付滯納金;
(4) If the charter does not pay freight before canceling the scheduled flight, the charter shall pay cancellation fee to the carrier within three business days (including the third day) after signing the cancellation contract. If the charter fails to pay such cancellation fee on time, overdue penalty will be charged in accordance with the charter contract.
(五) 如逾期未支付視為包機(jī)人自動(dòng)取消飛行,承運(yùn)人有權(quán)按照變更及取消條款中的規(guī)定向包機(jī)人收取取消費(fèi)同時(shí)需按照合同規(guī)定支付滯納金;
(5)If the charter fails to pay freight on time, it shall be deemed that the charter cancels the flight, and the carrier shall be entitled to charge the charter for any cancellation fee in accordance with the articles specified in the contract on change and cancellation of flights, and require the charter to pay penalty in accordance with the contract.
(六) 包機(jī)人應(yīng)付而逾期未付的款項(xiàng),承運(yùn)人有權(quán)自包機(jī)人超過(guò)約定付款期限的第一日起向包機(jī)人收取滯納金,日收取滯納金比例為未付款項(xiàng)的千分之五(5‰);
(6)The CHARTERER shall pay the overdue expense. In the event that any expenses remain unpaid after the due date, the CARRIER shall be entitled to collect overdue fine at 0.5% of the unpaid expense for every day in arrears, commencing on the first day of default.
(七) 包機(jī)人因特殊原因無(wú)法按照合同約定時(shí)間支付包機(jī)款需向承運(yùn)人提出申請(qǐng),承運(yùn)人同意后包機(jī)人需向承運(yùn)人提供書(shū)面《付款承諾書(shū)》(模板詳見(jiàn)附件五)。
(7)In case the CHARTERER can’t pay for the charter expense at the agreed time in the Contract due to special reasons, he/she shall request for a delayed payment to the CARRIER. With the consent of CARRIER, the CHARTERER shall provide CARRIER with the written Payment Commitment (see Appendix V for the template).
包機(jī)款項(xiàng)支付原則Payment Principles
(一)匯率標(biāo)準(zhǔn):美金折算匯率以承運(yùn)人英文版包機(jī)運(yùn)輸合同模板中規(guī)定為準(zhǔn),美金以外的幣種,則按照中國(guó)國(guó)家外匯管理局官網(wǎng)中首段飛行日期當(dāng)月的“當(dāng)月1日匯率”中的匯率進(jìn)行換算;
(1) Standard of exchange rate: conversion exchange rate of USD should be in accordance with the regulations in the carrier’s English version air charter transport contract template. As for other currencies, they should be converted in accordance with the exchange rate of the “exchange rate of the 1st of the month” on the month of the first flight period on the official website of China State Administration of Foreign Exchange;
(二)如包機(jī)人支付的包機(jī)款幣種和承運(yùn)人匯款賬戶幣種(美元、人民幣)不一致,則在包機(jī)款全款的基礎(chǔ)上加收1%手續(xù)費(fèi);
(2) If the currency of air charter fee paid by the charter is inconsistent with the currency (USD, RMB) of carrier’s remittance account, then commission fee which is 1% of the total amount of air charter fee will be additionally charged;
(三)包機(jī)人在支付包機(jī)款時(shí)需按照合同簽訂金額付款,在其間發(fā)生的所有費(fèi)用(如手續(xù)費(fèi)等)均由包機(jī)人自行承擔(dān);
(3) The charter should pay the air charter fee in accordance with the amount stipulated in the contract and all charges (such as commission charge) occurs during the air charter period should be undertaken by the charter;
承運(yùn)人合同負(fù)責(zé)人告知承運(yùn)人計(jì)財(cái)部包機(jī)人發(fā)票信息后3個(gè)工作日郵寄出發(fā)票,如發(fā)票方和合同方不一致,由合同方出具發(fā)票說(shuō)明;如發(fā)生包機(jī)合同簽署方與包機(jī)款支付方不一致的情況,需要付款方提供帶有付款方公章的書(shū)面說(shuō)明包機(jī)款方可入賬, 承運(yùn)人可提供的發(fā)票項(xiàng)目包括機(jī)票款和包機(jī)款兩種。
Article 50 The invoice shall be mailed 3 workdays after the contract responsible person of the CARRIER has told its Finance and Accounting Department about the CHARTERER’s charter information. In case of any inconsistency between the invoice party and Contract party, the Contract party shall issue invoice description. In case of any inconsistency between charter Contract parties and charter expense payment party, the payment party shall provide the written description with payment party’s official seal for the charter expense to be paid. CARRIER can provide two invoice items: air ticket expense and charter expense.
包機(jī)退款流程: Refund Process
(一) 退款是指包機(jī)人支付給承運(yùn)人的包機(jī)款大于合同應(yīng)繳納包機(jī)款時(shí),承運(yùn)人需退還包機(jī)人多余款項(xiàng)的事宜。
(1) Refund means when the charter expense paid to the CARRIER by the CHARTERER is more than that stipulated in the Contract, the CARRIER shall refund the additional expense to the CHARTERER.
(二) 包機(jī)人在所有退款材料提供齊全后5個(gè)工作日內(nèi)給包機(jī)人退回包機(jī)款。
(2) The additional expense shall be refunded within 5 workdays after the CHARTERER has provided all the refund materials.
(三) 退款材料包括:包機(jī)人付款水單、合同方和付款方不一致時(shí)提供的付款說(shuō)明,原始合同與新簽合同等材料。
(3) The refund material includes: CHARTERER payment note, payment description when there’s inconsistency between the contract parties and payment party, the original contract, newly signed contract, etc.
包機(jī)運(yùn)輸保險(xiǎn)條款Terms of Insurance
1、承運(yùn)人免費(fèi)贈(zèng)送包機(jī)乘客每人每航段價(jià)值人民幣200萬(wàn)元的保險(xiǎn)(詳見(jiàn)附件二)。若包機(jī)人提出額外增加保險(xiǎn)額度,承運(yùn)人可協(xié)助辦理,但由此產(chǎn)生的額外費(fèi)用由包機(jī)人自行承擔(dān)。
Article 52 The CARRIER grants every passenger a free insurance of RMB2000,000 yuan/flight leg (see Appendix II). Provided that the CHARTERER proposes to increase the insurance amount, the CARRIER may assist but all expenses thus incurred shall be borne by the CHARTERER.
2、包機(jī)方需在航班起飛前1個(gè)工作日16:00之前,按承運(yùn)方及保險(xiǎn)公司要求,
提供乘客詳細(xì)信息,以便承運(yùn)方為包機(jī)乘客申請(qǐng)辦理保險(xiǎn)。如因包機(jī)方逾期未提供乘客詳細(xì)信息或起飛前增加或者變更乘客名單,承運(yùn)方將不承諾提供免費(fèi)贈(zèng)送保險(xiǎn),且由此產(chǎn)生的不利法律后果,由包機(jī)方承擔(dān)。
Upon the request of the CARRIER and Insurance Company, the CHARTERER shall provide detailed information on passengers taking charter flights no later than 16:00 on the day before the first day of flight so as to file an application for complimentary insurance. The CARRIER does not guarantee the complimentary insurance, provided that the CHARTERER fails to provide detailed passenger information or add or amend passenger list before taking off. The CHARTERER will be held responsible for all legal consequences arising therefrom.
包機(jī)空運(yùn)價(jià)格條款Terms of Price
1、最低小時(shí)收費(fèi)Article 54 Minimum hourly charge
2、進(jìn)出港地面保障服務(wù)費(fèi)Ground Service Fee for Arrivals and Departures
3、額外機(jī)組費(fèi) Additional Crew Fee
4、加急費(fèi)收費(fèi)政策Urgent Charge
?。?)運(yùn)力確認(rèn)單時(shí)間:以運(yùn)力資源席收到呼叫中心席發(fā)送的運(yùn)力確認(rèn)單為準(zhǔn)。
Time of Transport Capacity Confirmation Slip:As per the time when the Transport Capacity Resourcereceived the Transport Capacity Confirmation Slip delivered by the Call Center.
(2)執(zhí)行任務(wù)時(shí)間:航班計(jì)劃首段任務(wù)起飛時(shí)間。
Time to operate:The takeoff time of the first segment as per the flight plan.
?。?)如同一單多航段飛行任務(wù)中,產(chǎn)生國(guó)內(nèi)民用、軍民合用和軍用機(jī)場(chǎng)加急計(jì)劃或國(guó)內(nèi)和國(guó)際加急計(jì)劃同時(shí)發(fā)生的情況,則按照就高原則一次性收取加急費(fèi);
In event that the occurrence of domestic civil, civil and military and military airport urgent plan or domestic and international urgent plan coincides in a single multi-segment flight mission, the urgent charge shall be paid in a one-off manner on a “whichever is higher” basis;
?。?)如同一單多航段飛行任務(wù)中,產(chǎn)生多個(gè)加急,則以就高原則,收取一次加急費(fèi)。
In event that more than one urgent charge occur in a single multi-segment flight mission, the urgent charge shall be paid in a one-off manner on a “whichever is higher” basis.
5、特殊機(jī)場(chǎng)收費(fèi)Special Airports Fees
6、其他費(fèi)用Other Fees:如通訊費(fèi)、除冰費(fèi)、機(jī)庫(kù)使用費(fèi)、特殊餐食費(fèi)、氧氣瓶費(fèi)用等,承運(yùn)人根據(jù)費(fèi)用實(shí)際發(fā)生情況向包機(jī)人收取。
Other fees, including communication fee, de-icing fee, hangar fee, special catering fee, oxygen cylinder fee, shall be paid by the CHARTERER according to the actual amount.
7、如包機(jī)人可明確變更后執(zhí)行航班的日期,按累計(jì)變更時(shí)間計(jì)算。
That the client specifies the flight date after postponing the original one shall be deemed as accumulated modification time.
取消包機(jī)如何收費(fèi)
1、如包機(jī)人不能明確推遲后執(zhí)行航班的日期,則按照原合同取消計(jì)算,簽訂取消合同并根據(jù)合同條款收取取消費(fèi)。
That the client fails to clearly prescribe the flight date after postponing the original one shall be deemed as contract cancellation. After the Contract is cancelled, the client shall pay the cancellation fee under the terms of the Contract.
2、包機(jī)合同簽訂后,包機(jī)人要求更改起飛時(shí)刻或航段,且提出變更時(shí)間不符合相關(guān)機(jī)場(chǎng)申請(qǐng)時(shí)限而導(dǎo)致承運(yùn)人計(jì)劃申請(qǐng)失敗的且包機(jī)人不再執(zhí)行原定航段的,則包機(jī)人需支付未變更前航段的取消費(fèi);
The CHARTERER shall pay the cancellation fee for the flight leg before the modification, in case the CHARTERER requests to modify the taking-off time or flight leg after the Contract is signed, and the proposed time does not comply with the time limit of application, resulting in the failure of the CARRIER's plan and the CHARTERER no longer implements the original flight leg.
3、因包機(jī)人原因(如惡意不通知承運(yùn)人起飛時(shí)刻變更等情況的發(fā)生)致使無(wú)法按照既定起飛時(shí)刻執(zhí)行飛行,則
Where the aircraft is unable to take off on the scheduled time due to the reasons arising from the CHARTERER, the following conditions shall apply:
(一) 如起飛時(shí)間離原定起飛時(shí)刻延誤在30分鐘內(nèi)(含)且繼續(xù)執(zhí)行后續(xù)飛行,則免收費(fèi)用;如取消后續(xù)飛行,則需支付由此產(chǎn)生的實(shí)際費(fèi)用;
(1) The CHARTERER shall be exempt from any expenses when the delay time of flight is 30 minutes (inclusive) from the scheduled departure time and the CHARTERER continues to take the follow-up flight; in case of the cancellation of follow-up flight, actual expenses thus incurred shall be borne by the CHARTERER;
(二) 如起飛時(shí)間大于原定起飛時(shí)刻30分鐘(不含),每延誤30分鐘包機(jī)人需支付人民幣5000元;不足30分鐘按照30分鐘計(jì)算,以彌補(bǔ)承運(yùn)人由此產(chǎn)生的相關(guān)費(fèi)用(如APU開(kāi)放費(fèi)、機(jī)組執(zhí)勤費(fèi)等);
(2) When the delay time of flight is more than 30 minutes (exclusive) from the scheduled departure time, the CHARTERER shall pay RMB 5,000 yuan per 30 minutes for the cost of delay. Delay time less than 30 minutes will be counted as 30 minutes. Relevant expenses (e.g. APU usage fee and flight crew service fee) occurred therefrom shall reimbursed by the CHARTERER.
(三) 如起飛時(shí)間離原定起飛時(shí)刻超過(guò)2個(gè)小時(shí)(不含)仍然未接到包機(jī)人確認(rèn)新起飛時(shí)刻的通知,則承運(yùn)人有權(quán)取消飛行計(jì)劃并按照包機(jī)款總額的100%收取取消費(fèi)及由此產(chǎn)生的相關(guān)費(fèi)用(如調(diào)機(jī)費(fèi)用等),同時(shí)承運(yùn)人不承擔(dān)由此產(chǎn)生的違約責(zé)任和包機(jī)人的相關(guān)損失;
(3) When the delay time of flight is more than 2 hours (exclusive) from the scheduled departure time without any notice of the new departure time from the CHARTERER, the CARRIER shall have the right to cancel the fight plan and charge the cancellation fee of 100% of the charter expense as well as any additional expenses incurred therefrom (e.g. ferry flight fee). Meanwhile, the CARRIER shall be exempted from liability for breach of Contract and the loss related to the CHARTERER.
(四) 如包機(jī)人拒付相關(guān)費(fèi)用,承運(yùn)人有權(quán)拒絕包機(jī)人后續(xù)飛行直至支付完畢相關(guān)費(fèi)用;
(4) In case the CHARTERER refuses to pay relevant expenses, the CARRIER shall have the right to suspend the follow-up flight until such expenses are paid in full.
(五) “原定起飛時(shí)刻”以包機(jī)人簽回的包機(jī)合同中注明的時(shí)刻為準(zhǔn)。
(5) “Scheduled Departure Time” is subject to the final confirmation stated in the Charter Flight Contract countersigned by the CHARTERER.
4、由于不可抗力原因(如天氣、自然災(zāi)害、戰(zhàn)爭(zhēng)、空中管制等)致使飛行任務(wù)未按原定計(jì)劃執(zhí)行,承運(yùn)人和包機(jī)人免責(zé),但雙方因不可抗力遭受的損失由雙方自行承擔(dān);
The CARRIER and CHARTERER shall be exempted from liability for failure to implement the scheduled flight mission in light of the impact of the event of force majeure (such as weather, natural disasters, wars and air traffic control). Both parties shall bear their respective liabilities according to losses due to force majeure;
5、由于包機(jī)人原因(如乘客晚到、證件不符、攜帶違禁品等)致使飛行任務(wù)未按原定計(jì)劃執(zhí)行,承運(yùn)人不承擔(dān)由此產(chǎn)生的違約責(zé)任,但包機(jī)人需支付承運(yùn)人因包機(jī)人原因而導(dǎo)致承運(yùn)人違約所產(chǎn)生的實(shí)際費(fèi)用;
The CARRIER shall be exempted from the liability for breach of Contract for failure to implement the scheduled flight mission in light of the reasons caused by the CHARTERER (such as passenger’s late arrival, inconsistent documentation, carrying any contraband). The CHARTERER shall assume any expenses arising from the said failure or breach of Contract;
6、由于承運(yùn)人原因(不含天氣、禁航、民航保障、戰(zhàn)爭(zhēng)、罷工、軍事、空中管制及其他不可避免的事由)導(dǎo)致某航段飛行任務(wù)延誤、變更或取消等無(wú)法履約的情況發(fā)生,現(xiàn)將處理原則明確如下,除此以外,承運(yùn)人不承擔(dān)其他責(zé)任:
Under the circumstance of performance failure such as the flight mission delay, change, or cancellation, etc. on a leg because of the Carrier (excluding the weather, flight ban, civil aviation guarantee, war, strike, military affairs, air control, and other inevitable subjects), the treatment principles are specified as follows. Otherwise, the Carrier will not assume any other responsibilities:
(一) 由于承運(yùn)人原因造成原定飛行任務(wù)無(wú)法成行,經(jīng)包機(jī)人同意承運(yùn)人將根據(jù)“運(yùn)力調(diào)配原則”盡可能優(yōu)先安排本公司其他運(yùn)力完成飛行任務(wù),包機(jī)款則按照調(diào)換機(jī)型結(jié)算原則處理;
In case that the scheduled flight mission is failed because of the carrier, with the consent of the charter flight person, the carrier will try to give priority to arranging other air capacities of the Company to complete the flight mission according to “Airline Capacity Flight Principle” in which the charter flight amount will be settled according to the airplane type change settlement principle;
(二) 因承運(yùn)人原因造成超過(guò)約定起飛時(shí)間不能執(zhí)行包機(jī)飛行,在3小時(shí)以上(不含)至24小時(shí)(含)但飛行執(zhí)行完畢,則承運(yùn)人應(yīng)退還包機(jī)人被延誤航段人民幣1萬(wàn)元;
In case that the departure time surpasses the scheduled departure time because of the carrier and the charter flight is failed, and the delay time is from 3h (exclusive) to 24h (inclusive) but the flight mission is fulfilled, the carrier shall return RMB 10,000 Yuan to the charter flight person for the delayed leg;
(三) 因承運(yùn)人原因造成超過(guò)約定起飛時(shí)間不能執(zhí)行包機(jī)飛行,超過(guò)24小時(shí)(不含)但飛行執(zhí)行完畢,承運(yùn)人應(yīng)退還包機(jī)人被延誤航段人民幣3萬(wàn)元,同時(shí)承運(yùn)人應(yīng)根據(jù)當(dāng)?shù)貦C(jī)場(chǎng)條件結(jié)合承運(yùn)人服務(wù)標(biāo)準(zhǔn)為乘客提供食宿及地面交通;
In case that the departure time surpasses the scheduled departure time because of the carrier and the charter flight is failed, and the delay time surpasses 24h (exclusive) but the flight mission is fulfilled, the carrier shall return RMB 30,000 Yuan to the charter flight person for the delayed leg. Meanwhile, the carrier shall provide board and lodging, and ground traffic for passengers according to the local airport conditions and the service standards of carriers;
(四) 因承運(yùn)人原因造成超過(guò)約定起飛時(shí)間不能執(zhí)行包機(jī)飛行且包機(jī)人要求取消被延誤航段或關(guān)聯(lián)的后續(xù)飛行任務(wù),則承運(yùn)人免收包機(jī)人取消費(fèi)同時(shí)退還包機(jī)人未執(zhí)行航段全額收費(fèi),承運(yùn)人應(yīng)協(xié)助包機(jī)人購(gòu)買(mǎi)該延誤航段機(jī)票或安排其他地面交通方式前往第一目的地;
In case that the departure time surpasses the scheduled departure time because of the carrier and the charter flight is failed, and the charter flight person requires to cancel the delayed leg or related follow-up flight missions, the carrier shall not charge the cancellation fee against the charter flight person and meanwhile, return the full charge on the legs which are not executed to the charter flight person. The carrier shall assist the charter flight person in purchasing the airline ticket for the delayed leg or arrange other ground means of transportation to head for the first destination;
(五) 由于承運(yùn)人原因造成原定飛行任務(wù)無(wú)法成行同時(shí)在承運(yùn)人自有運(yùn)力無(wú)法滿足飛行計(jì)劃的情況下,則承運(yùn)人應(yīng)在合理時(shí)間內(nèi)協(xié)助包機(jī)人包租另一架飛機(jī)執(zhí)行任務(wù),包機(jī)款按照包機(jī)人與承運(yùn)人簽訂合同中的價(jià)格結(jié)算;
In case that the carrier fails to execute the scheduled flight mission and his airline capacity fails to satisfy the flight plan, the carrier shall assist the charter flight person in renting another airplane to execute the flight mission within a reasonable time, in which the charter flight amount shall be settled according to the price in the contract executed by and between the charter flight person and the carrier;
(六) 由于承運(yùn)人原因造成原定飛行任務(wù)無(wú)法成行,但包機(jī)人同意變更飛行日期,即離原定飛行任務(wù)中首段飛行日期30天內(nèi)(含)再次飛行且包機(jī)款金額大于等于原定飛行,則承運(yùn)人免收包機(jī)人變更費(fèi)(包括時(shí)刻和航線)且給予同一包機(jī)人下次飛行包機(jī)款全款一次性優(yōu)惠人民幣3萬(wàn)元。
In case that the carrier fails to execute the scheduled flight mission but the charter flight person agrees to change the flight date, i.e. re-execute the flight mission within 30 days (including) upon the fail on the scheduled flight mission, with the charter flight amount more than or equal to that of the scheduled flight mission, the carrier shall not charge the change fee (including time and airline) to the charter flight person and offer preferential price of RMB 30,000 Yuan on the next full charter flight amount to the charter flight person.
